We have signed a contract With Osdany Gonzalez Owner of Miami Cultured Marble Inc. to make us Marble Top Tables on May 8 2012 PO number 2248 and deliver them to:

#1-10-24×24 tops
#2-30-32×32 tops
#3-19-32×48 tops
#4-4-Handi cap table 32×48 frames and tops.
#5-Install Table bases to Marble Tops.
Delivery date was to be right after Memorial day weekend "Tuesday May 29 2012".
*Osdany Gonzalez came a week later with Six (6) damaged tables and without Handicap Table.
*Table #1 had a mosquito varnished over it,
*Table #2 had mans hair varnished over it
*Four (4) Tables had chips and dings on them, a week later one
*(1) table broke in four (4) pieces and
*One (1) table base was not installed.
Reasoning for not having the Handicap tables was that his driver on the way got stopped for speeding and got arrested.
*Osdany Gonzalez Offered us a $500.00 cash reword if he will not complete the Job by: June 21 2012 5:00pm See attached Marked #2 a copy from his text message to us.

*Osdany Gonzalez made promises to take care of the 6 damaged tables and delivery the 4 Handicap tables but has not done so as of June 29/2012. There is no sign of Osdany or the missing Tables, and the damaged table have not been fixed. Osdany Offers on his website a one year guaranty, we are very concerned.
*We have made many attempt to contact Osdany Gonzalez by phone calls, email and text messages, attached are copies of text message 13 pages and emails. See Attached Item #3A & 3B
*We have refunded the hotel for the 4 missing tables and gave a full credit on the 6 damaged tables for a total of $2140, see copy of check item marked 4.

Danny, this is Sammy from Tamirson Equipment & Supplies. I hope that you are well and that no harm has come to you G-d Forbid, it’s just hard for me to believe that you want return any of our calls.
Danny you are creating a major problem a big mess and embarrassment for me and for your company as well from the hotel owners. Firstly you are not returning any of our calls from Monday June 4th or my, text messages concerning the Hotel issues with 6 tables that have problems such as" mosquitoes inserted in one table covered with varnish, Hair Inserted on another table covered with varnish, and 4 other tables with cuts and dings as well as the missing 4 Handicap tables 30×40 frames that will support your 30×40 Marble Tops.
Danny you were paid in full for the whole Job, I don’t understand the reason for this silent treatment, you have also overcharge us by $612,84, you then gave us a check that was return for ISF, check number 1006 dated 6/1/2012 and you are not communicating with us. is that the way to run a business?
You promise to call me back right away after our conversation on June 4th 2012 at 10am in the morning and that was the last time I heard from you, I really hope you are well, and that no harm has come to you G-d Forbid, that’s not like you!! We are very concern, and we need to know right away when you are planning to come and finish the job before G-d forbid the hotel will take us to court.
As per our last conversation you promise you will fix all the 6 defected tables today Friday June 15 2012 in the morning as well as deliver the 4 handicap tables and as of now 5:00 pm no word from you.
Danny Please get back to me ASAP. Lets correct the problem before it’s too late.

(My client from saint Thomas was here to see you and possible give us an order for the black and white tops and I could not get a hold of you as well, he saw the samples you gave me.)

Danny, the Hotel is demanding now a full refund for all the tables. You promise to deliver the handicap tables today, when we spoke this morning you said they are on the way with the tables and they will repair the 6 defecated tables as well.
You never followed through as to why you did not show up today as you promised on Sunday. You could have at list stop by and repaired the 6 tables in good faith, do something!!! You made many promise but done nothing and therefore the hotel no longer wish to do business with you especially when you give a one year guaranty, they just don’t trust you anymore.
Again they want A full refund, or else they WILL take US to court. They want you to pick up all your tables asap. Is this what you want Danny? they are not playing any more, they are very serious.
You don’t return calls, text messages, seems like you just don’t care.
If by chance you are planning to come tomorrow maybe, maybe I can talk them into excepting our sincere apology and be done with this nightmare. It’s your choice!!! you can make it right. I need to hear back from you tonight, if I don’t I will assume the worst.
